Five years of correctional work without internment for a son for the crime of attack that did not occur

Noe Martínez Avile has already been interrogated several times since he was 11 years old because of his father's activities. He has been interrogated without any of his adult relatives being present. For some years he has been very afraid of the police, and when he sees one he gets very nervous. On September 5, agents of the State Security and the National Revolutionary Police arrived at the home of Noe's father Raúl Martínez Caraballo and his family, where Noe was alone with his mother. The officers entered his house without showing a search warrant. The dogs of the family began to bark and approach the police. Noe threw a stone to the dogs so they would not attack the police, and the stone hit one of his aunts who came to the house to see what happened. The stone did not touch any officer. Even so, Noe, who just turned 17 years old, is accused of an attack and, on December 8, he received the sentence that condemns him to 5 years of correctional work without internment. The original sentence was 5 years deprivation of liberty. His father, Raúl, who arrived home during the search and who was taken to the police station, where he stayed for 4 days, thinks that one of the police officers hurt his foot when he was putting Raúl in the patrol car, but now he is accusing Noe of doing it. During the search his computer, a radio, personal documents and books were occupied and the officers left the house destroyed. Noe was arrested after the arrest of his father and they let him leave after 3 days with a fine of 1000 CUP (about 32 euros) and the accusation of attack. During his detention he was interrogated several times asking about his father's activities.
