Niober was arrested by officials from the State Security (DSE), at the “Reparto Caribe Shopping”. The events occurred when Niober was pasting images of the national hero José Martí. The policemen, who commited injustices against Niober, were recognized as: Leonis, Kevin or Edwin Jefferson, Víctor Víctor, Luis Ángel and Roberto along with two unidentified policemen. The Marti's phrases emphasized democracy, and invited people to participate in the “Revolución Martiana si, Revolución socialista no” campaign, assemble by “Compromiso Democratico”. The campaign consists of bringing José Marti's ideas to the streets of Cuba.
Niober was transferred to the police station called "Park 24". Lieutenant Lazara Leyva, in charge of the case, set a warning on him for being related to Isael Poveda Silva and Yaremis Buqueriget. She also said that Niober was a person who does not work. Niober in defense, stated that these women are not bad persons, and that he is not a lazy person “because he works more than all the police." The lieutenant felt attacked, as a response, she verbally assaults Niober. The other police officers in the act (approximately 8) surrounded him and beat him, including Lieutenant Jorge Juárez Chávez. Juárez Chávez commented that they must beat all opponents to death. Niober was released around 6 in the afternoon after he was fined with 30 pesos for the alleged offense of disturbance order.
