On Tuesday, July 13, 2021, Loreto Hernández García is summoned by Héctor de la Fe Freire, an officer of the Political Police. The victim is accused of being one of the promoters of the protest of Sunday, July 11, 2021, so he is arrested and sent to the criminal investigation of Caibarien.
Loreto Hernandez is sent to an isolation center for being infected with Covid-19. Then, on July 19, 2021, the Municipal Prosecutor's Office of Placetas places him under a precautionary measure of provisional imprisonment, which he must serve in the Men's Penitentiary Center, La Pendiente, after recovering from Covid-19.
During all this time, Loreto Hernández has been detained without due process, since he was not presented before the competent court in the time established for the oral trial. Also, he was deprived of the right to be represented by a State attorney, a right due to the lack of financial resources to hire one.
The trial against him was held between December 15 and 17, 2021 in the People's Municipal Court of Santa Clara, where he was sentenced to 8 years of imprisonment for the crimes of public disorder, contempt and assault.
