The victim was summoned to a police station without any explanation or warning that he would be arrested. Once he arrived at the police station, he was informed that he was under arrest for conspiring to plan an assassination. The victim denied the charges and claimed that the real reason why he was being detained was because of his opposition to the Cuban regime and his protests. There was a murder committed in Banes six months prior, and the victim happened to be near the crime when it happened. According to testimony, the victim was helping out in figuring out the murder with other bystanders. He says that his detention is purely political and was previously detained and beaten for merely being the brother of member of the Moviemiento Union Fraternal de la Lealtad y la Fidelidad.
