Criminal process vitiated and a confused trial Lady in White is victimize even more



On May 8, 2016, Lady in White Rosa Escalona Gómez and her family were found to be victims of two bandits armed with tubes who beat them (you can see details of this case below this article). On Rosa's own initiative, she discovered the criminals were Aristides Fernandez Perez and Raul Fernandez Leyva and she accused them. The court was held on 23.11.2016 at the Municipal People's Court in Holguín, where Rosa asked for 3 years of prison for Fernández Pérez and 10 months for Fernández Leyva. Despite having been previously tried 2 times by court and accepted that they did beat them with the tubes, their defendant demanded the acquittal on all charges since they were people with a good political behavior and the Rosa's husband's spleen that had to be removed due to the serious injuries that did not serve him for anything. Rosa's family was discriminated during the trial: They were not allowed to enter to the room where the trial was held; The witness statements of her two sons were not taken and the reason for it was that everyone was saying the same; The statements of Rosa and her son were not dictated to the recorder. They were not informed about the sentence and the process it self; the policeman with number 22050 was harassing Rosa and throwing them out of the process. The policeman did not even let Rosa to go to the bathroom, he did not allow her to sit at the reception at a place where everyone was sitting and he was watching her all the time. He did not let her to talk to the prosecutor even though the president of the court told her to wait there for him. No doctor that would testify about the injuries that were present. The prosecutor informed her that he agreed with the defendants opinion. When she was going to ask about the judge's decision, she was told that they could not speak about it with her. She is sure that despite everything being in her favor, they will leave without any punishment.
